WRITING A WILL
Making a Will Matters
Our expertise focuses on creating Spanish Wills that allow for the Law of your Nationality to be included. We help to ensure your wishes are easily understood to avoid misinformation and disputes. The laws in Spain are different to other countries. For example Spanish law does not recognise Trusts.
We can guide you on how to create a legacy that is legal and valid. As professional Will Writers we have access to Solicitors should an estate be particularly complicated. In some cases we will refer if the need arises. Without a will, the process can be much more costly and time-consuming, particularly if there are those who feel entitled to claim your estate.
The importance of having a will—a Spanish will. To provide peace of mind, ensuring the process is as straightforward and stress-free as possible for your loved ones.
We listen. A skill much taken for granted but listening to our clients and taking care with the entire process of creating legacies is our number one passion and priority. We are not here to sell you other products. Our service is only to ensure your Will reflects your wishes. Sharing our knowledge. Bring diligent about keeping up to date with the laws of your nationality (not something a notary is required to do).

FUNERAL PLANS
Beneficiaries of Spanish estates are subject to inheritance tax, the amount will depend on what region of Spain they live in. Laws change, governing bodies change and some of us benefit and others don't.
Each regional government has created their own rules. There is a sliding scale for the percentage of the tax based on the relationship of the beneficiary. For example if the Heir is close family their tax burden will be far less than a friend who is not related.
The tax implications of inheriting a Spanish estate can be complex. The beneficiaries of your estate will likely need specialist advice. Understanding this in advance may help your beneficiaries avoid future pitfalls and unexpected tax liabilities.
We can signpost you to a Tax specialist that can answer any questions on this important topic.
Failure to draft a Spanish Will can result in fines being levied for any delays in the administration of your Estate. Spain has strict deadlines with regard to inheritance legislation. Heirs will have to contend with more bureaucracy and complications that can arise when a relative dies intestate.

Pet Legacy - Lifetime Care Plan®
Invest in their future for only 79 euros
Creating a plan for your pet
Taking care of our pets is something we do naturally but we also need to look after them even when we are no longer here to do it.
Just like with children and guardianship, a legacy plan can outline specific caretakers who will be asked to step in should you become incapacitated or pass away unexpectedly.
It’s important to think through what is important to you, and the needs of your pet.
Do your goals involve specific people? If you have specifics for the person(s) or type of person you’d like to care for your dogs, cats, horses, donkeys, birds..it is important that you create a plan and an agreement between you and any care giver.
Do your goals involve their financial needs? In a Spanish Will you’re not able to leave funds directly to your pet. To ensure the standards of care are met consider leaving some funds to someone who will take ownership, a Registered Charity and or your pets Veterinarian.
For example, maybe your dog is diabetic and requires daily insulin shots. You could allocate funds to the business holding the Veterinary account which is dedicated to the care of your pet.
Within the Pet Legacy - Lifetime Care Plan® we have provision for a detailed account of your pets needs, legal identifiers, any insurance policies, the standard of care required and generally how you wish any funding to be spent. This document will be highlighted as a codicil to the Will and can be used alongside your Will here and also in your home country. It is an important document intended to provide instructions to the Executors of your Estate.
As part of the plan we give our clients a special 'Keep Them Safe' card with details of who to call in an emergency.
Can I leave my Pets care to a Charity rather than a person?
If you’d rather leave your companions to an organisation rather than a person, many licensed charities have programs for their care and rehoming. A Spanish registered charity should not have to pay any inheritance tax in Spain on a legacy made in a Will
Due diligence is necessary into whatever organisation or individual you choose to be sure that they’ll take care of your pets and rehome them the same way you would! We can guide you with these important decisions.
What happens if you don’t have a plan for your pet?Unfortunately If there is nothing named, it is left to be distributed according to whoever ends up dealing with your estate. Sadly it might be someone with no interest in your pets. Even close relatives have been spotted advertising free home wanted on the internet for their parents beloved companions. Not the best way to safeguard their quality of life.
If you care about what happens to your best friends ..make a plan for their future.
“ Thanks to the Simply Spanish team. Collected our Wills today from the Notary all went smoothly.
