Succession Law varies considerably from one country to another. New E.U. legislation known as Brussels IV / ruling EU 650/2012 gave expatriates in Spain something very important... the right to choose. The choice to make a will using the Law of their own Nationality. 

For those who die intestate in Spain there is no choice and the inheritance will be governed by the Spanish law of succession which favours immediate heirs or next of kin, not spouses, partners or friends.

Making a Will and arranging a Funeral Plan in Spain really matters!

Do you know how many Wills are contested each year? More than perhaps you realise. Most of these are badly written with loophole's allowing for example someone who was strictly excluded from inheriting - to be able to contest the Will.

Recently in the Supreme Court the legal principle of Testamentary Freedom was upheld which is good news. This was largely due to the Will Writer and other witnesses having solid evidence of the deceased mental capacity at the time of writing the Will.

This case demonstrated the need for a process that can be tracked and used as evidence in a court of Law. Another good reason to invest in the services of a professional Will Writer.

By choosing the Law of your nationality it is  important to know about any cases that may implicate your legacy in the future.

Unless you have a Will, when you die your estate will pass under the Rules of Intestacy. This could mean your legal spouse will only inherit up to 50% of your estate. The rest distributed between children or close relatives.

Without a Will in place, if you are not married but you are living with someone, they will not inherit anything under Spanish Law.

A Spanish Will only covers your estate in Spain. If you have property, savings etc in another country you will need a separate Will.

To be clear - a Spanish Will is valid for Spanish assets!

It is recommended to make a new Will as your life changes such as getting married or divorced, buying a property or having children.

Frequently Asked Questions

What steps are require to create a Simply Spanish Will?

First step is to contact us!

  • We answer any questions you may have
  • A Consultation is arranged in the comfort of your own Home, at our Meeting room in Altea, at a Hospital or by Telephone Call or Zoom. Please allow a minimum of one hour for our meeting.
  • Comprehensive notes taken at the Consultation detailing all of your wishes will be formatted and sent to you for approval together with an invoice for our service's.
  • Once instructed and payment is received we automatically  progress to creating a draft of the Dual Column Bilingual Last Will & Testament   
  • The draft will be sent to you for approval and to check there are no further amendments required. It is important to get everything right before it is sent to a Notary
  • We will arrange an appointment with the relevant Notary   (Notary Fees are paid direct to them. Their charge can range from 60 to 75 euros per Will).
  • The date will depend on the Notaries availability and of course yours too.
  • We attend the Notary with you!
  • If you are overseas, we will arrange it for when you arrive in Spain 
  • For our clients in Palliative Care we can arrange for a Notary to visit you. (The Notary  may charge extra but we will get a quote )
  • Once the document is notarised you will be given a hard copy of the Will and an email copy will be sent to you. The Notary will keep their own copy.  After which the Will is sent to the Central Registry in Madrid part of the Ministry of Justice.  It is a Closed document which means nothing can be added or removed. It is stored securely and can only be accessed by those acting in a legal capacity. If you wish to make changes a completely new will has to be arranged and notarised.
